We are experienced specialists who serve clients in a wide range of environmental matters.  We keep our fingers on the environmental pulse at both the local and national level and minimize risk for our clients by devising solutions that make both good business sense and sound legal sense.  We offer a depth and level of expertise generally found only in environmental specialty firms, including corporate, real estate, and litigation.

We represent clients before all federal, state and local environmental agencies and in environmental litigation.  Our outstanding success can be attributed to skill, dedication, strong technical expertise, and superb environmental education. 

In addition to handling contested matters, we regularly counsel clients about the laws governing air pollution, groundwater and surface water quality, soil contamination, and indoor environmental quality (including such matters as asbestos abatement and removal, regulations governing removal of lead paint and “sick building” issues).  On human health and safety issues, our expertise and experience covers OSHA, epidemiological issues, product safety and liability, toxic torts and pesticide registration and transfer matters.

The areas of environmental, health and safety law in which the firm represent clients include the following:

  • Hazardous waste management under the federal Resource Conservation and Recovery Act (“RCRA”) and state law analogues, including strategies to minimize the risks incidental to the acquisition and development of real property.

  • “Superfund” and other matters involving contaminated real property.

  • State voluntary cleanup programs, including counseling foreclosing lenders on the formulation of strategies for the disposition of property.

  • Water pollution and effluent discharges, including defending clients in administrative proceedings.

  • Air pollution control and permit requirements, including Title V, “major source” regulations and state facility permits.

  • Permit applications and applications for exemption from permit requirements under a variety of federal and state laws.

  • Defense of criminal matters, including investigations into historic waste disposal practices.

  • Toxic tort, personal injury and property damage claims.

  • Occupational health and safety.

  • TSCA compliance and litigation.

  • Applications for registration of pesticides and representation of clients in data compensation matters under the Federal Insecticide, Fungicide and Rodenticide Act (“FIFRA”).

  • Environmental due diligence, assessments and audits, including supervising consultants in multi-site investigations.

  • Insurance coverage negotiation and litigation.

  • Food and drug laws, including advice about the applicability of GRAS (“generally recognized as safe”) and HACCP (hazard analysis critical control point) regulations.
